These Terms & Conditions ("Terms") govern access to and use of the MVSEP website, mobile applications, APIs, and related services (collectively, the "Service").

The Service is operated by Sole Proprietor (YTT) "Elmurodov Olimjon Ermat o'g'li" (the "Operator").

1. Acceptance of Terms

By accessing or using the Service, You agree to be bound by these Terms. If You do not agree to these Terms, You must not use the Service.

2. Description of Service

MVSEP provides cloud-based audio processing services and AI-powered tools, including but not limited to stem separation, enhancement, restoration, dereverberation, and related audio processing features. Certain features and processing capabilities require payment.

3. Accounts

You are responsible for maintaining the confidentiality of Your account credentials and for all activities performed under Your account.

4. Payments

Payments for Credits or other paid features may be processed through third-party payment providers, including app marketplace operators such as Apple App Store and Google Play Store.

Prices, credit amounts, processing limits, and available features may change at any time without prior notice.

Unless otherwise stated, all applicable taxes, bank fees, transfer fees, currency conversion fees, and similar charges are the responsibility of the purchaser.

For purchases made through:

• Apple App Store – Billing and refunds are governed exclusively by Apple’s terms and policies.
• Google Play Store – Billing and refunds are subject to Google Play’s terms and billing policies.

Platform-specific rules may override these Terms where required.

Unless explicitly stated otherwise, payments made directly through the website are one-time and non-recurring.

By completing a purchase, You acknowledge that digital processing begins upon use of Credits and that refund eligibility is subject to the applicable Refund Policy.

5. Refund Policy

Due to the digital and immediately consumable nature of the Service, processing jobs are considered delivered once completed.

Refunds for unused or minimally used Credits may be available in accordance with the applicable Refund Policy.

Once Credits have been substantially used or processing jobs have been completed, purchases become non-refundable except where required by applicable law.

For purchases made through Apple App Store or Google Play Store, platform-specific refund policies apply.

6. User Content

You may upload audio or other media files for processing through the Service.

By uploading content, You represent and warrant that:

• You own the content or possess all necessary rights and permissions to process it;
• The content does not infringe third-party intellectual property, privacy, publicity, or other legal rights;
• The content does not violate applicable laws or regulations.

The Operator does not claim ownership over uploaded content or generated outputs.

You retain ownership of uploaded content and generated outputs, subject to applicable third-party rights.

The Operator is not responsible for uploaded content, generated outputs, or how such outputs are subsequently used.

7. Intellectual Property

All software, infrastructure, algorithms, branding, interfaces, website content, and design elements of the Service remain the intellectual property of the Operator or applicable licensors.

Processed outputs generated through the Service may be used commercially by You, provided You possess the necessary rights to the original submitted content.

The Service may utilize third-party or open-source technologies, models, or components subject to their respective licenses.

8. Service Availability

The Service is provided on an "as is" and "as available" basis.

The Operator does not guarantee uninterrupted availability, specific processing speeds, processing accuracy, continuous uptime, or error-free operation.

Temporary interruptions, maintenance periods, infrastructure failures, model limitations, or third-party service disruptions may occur.

9. Limitation of Liability

To the maximum extent permitted by law, the Operator shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to use of the Service.

This includes, but is not limited to:

• Loss of profits;
• Loss of business opportunities;
• Data loss;
• Processing inaccuracies;
• Service interruptions.

To the maximum extent permitted by law, the total liability of the Operator shall not exceed the total amount paid by You for the Service during the 12 months preceding the claim.

10. Termination

The Operator reserves the right to suspend, restrict, or terminate access to the Service at any time for violations of these Terms, applicable laws, abuse of the Service, security concerns, or harmful activity affecting the platform or other users.

11. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Uzbekistan.

Any disputes arising from these Terms or use of the Service shall be resolved in the competent courts of Uzbekistan.

12. Analytics

The website (mvsep.com) may use analytics and diagnostic tools, including Yandex Metrica and similar services, for performance monitoring, analytics, and service improvement purposes.

The mobile applications may use platform analytics, crash reporting, and diagnostic services.

13. Changes to Terms

The Operator may update or modify these Terms at any time.

Continued use of the Service after updated Terms become effective constitutes acceptance of the revised Terms.
